Russian IT-associations ask to cancel the requirement to transfer personal data of employees to the authorities
Three large Russian IT-associations complained about the requirements of the Moscow mayor’s office to transfer personal data of employees transferred to a remote mode of work. The letter was signed by the Association of Computer and Information Technology Enterprises (APKIT), the Association of Software Developers “Otechestvenny Soft” and “Russoft”. They argue that employers have no right to collect and transfer personal data of employees to third parties without special consent. In this case, the employer is responsible for the refusal.
Executive Director of APKIT Nikolay Komlev said that the mayor’s office is using the new outbreak of coronavirus as an excuse to build a system for spying on residents of the capital. He noted that refusal to provide information is fraught with fines, and their provision violates the rules on non-disclosure of personal data. The owner of the Katkov and Partners law firm Pavel Katkov noted that processing such a volume of personal data is a new task for the mayor’s office, which is fraught with various failures and leaks.
The mayor’s office believes that the requested information is not personal data. The employer can transfer them without reference to the employee’s full name. According to them, this information will only allow to determine the effectiveness and fulfillment of the requirements of the authorities.
On October 1, Sergei Sobyanin ordered Moscow companies to transfer a third of their employees to a remote mode of work. The mayor of Moscow also demanded that from October 12, employers weekly transmit to the authorities information about employees transferred to remote work. We are talking about the transfer of data from transport cards “Troika” and “Strelka”, mobile phones, social cards, travel tickets and registration numbers of cars.
